Terms of Service

1. Agreement to Terms
By accessing or using Metal on Cloud services ("Services"), you agree to be bound by these Terms of Service. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Services Description
Metal on Cloud provides:
- Bare metal server provisioning and management (MaaS)
- Colocation services in Tier-III data centers
- Private rack and cage solutions
- Network connectivity and bandwidth services
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable laws or regulations
- Infringe intellectual property rights
- Distribute malware or conduct cyberattacks
- Send spam or unsolicited communications
- Host content that is illegal, harmful, or abusive
- Attempt to gain unauthorized access to systems
5. Payment Terms
- Services are billed monthly in advance unless otherwise agreed
- All fees are in US Dollars and exclusive of applicable taxes
- Late payments may incur a 1.5% monthly interest charge
- We reserve the right to suspend services for non-payment after 7 days
- Refunds are provided per our SLA for service credits only
6. Service Level Agreement
Our SLA guarantees are detailed in our separate Service Level Agreement. Service credits are your sole and exclusive remedy for any failure to meet SLA commitments.
7. Data Responsibility
You are responsible for all data stored on our infrastructure. We recommend maintaining backups. For colocation services, you are responsible for your own hardware and data.
8. Limitation of Liability
To the maximum extent permitted by law, Metal on Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
9. Termination
Either party may terminate services with 30 days written notice. We may immediately suspend or terminate services for violation of these terms or the Acceptable Use Policy. Upon termination, you must remove all equipment (colocation) within 14 days.
10. Governing Law
These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
